The Lahore High Court (LHC) has ruled that creating, administering, or belonging to a WhatsApp group does not automatically make a person criminally responsible for messages posted by other members. The decision came while rejecting the post-arrest bail of a man accused of uploading and sharing blasphemous content through WhatsApp groups. The judge clarified that criminal liability under PECA arises only when an individual personally prepares, uploads, forwards, or disseminates unlawful content, or when a group administrator actively participates in or creates a group for illegal purposes.
